East Side Cheesecakes ("East Side Cheesecakes," "ESCC," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit our website, place an order, submit a catering or Cheesecake Trolley inquiry, join a mailing list, communicate with us, or otherwise use our online services (collectively, the "Services").

This Privacy Policy applies to information collected through our website and the online services we use to operate our business, including Wix, Ecwid by Lightspeed, HoneyBook, payment processors, email and text-message services, analytics providers, and related service providers. It does not apply to third-party websites or services that we do not control.

By using the Services, you acknowledge the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not provide personal information through the Services.

1. Information We Collect

The information we collect depends on how you interact with us.

A. Information you provide directly

We may collect:

  • Contact information, such as your name, email address, telephone number, billing address, delivery address, venue address, and onsite contact details.

  • Order and transaction information, such as the products or services requested or purchased, quantities, flavors, dietary requests, pickup or delivery selections, delivery instructions, event details, order dates, payment status, and transaction history.

  • Event and catering information, such as event type, event date and time, venue, guest count, budget range, desired service level, design preferences, colors, packaging, branding, setup requirements, accessibility or loading instructions, and other details you choose to provide.

  • Uploaded content, such as inspiration photographs, invitations, mood boards, logos, color references, design files, and other images or materials submitted with an inquiry.

  • Communications, including emails, text messages, form responses, customer-service requests, reviews, feedback, and messages sent through social media or other channels.

  • Marketing preferences, such as whether you wish to receive launch announcements, newsletters, promotional messages, or other updates.

  • Account information, if account or customer-login features are offered, such as login credentials, saved preferences, and account activity.

Please do not submit sensitive personal information that we do not request, such as Social Security numbers, government identification numbers, medical records, or financial account credentials.

B. Payment information

Payments may be processed by third-party payment processors through Ecwid by Lightspeed, HoneyBook, or another payment service. These providers may collect payment-card details, billing information, and other information needed to process a transaction. East Side Cheesecakes generally does not receive or store complete payment-card numbers or card security codes. Payment providers process information under their own privacy policies and security practices.

C. Information collected automatically

When you use the Services, we and our service providers may automatically collect:

  • browser type and device type;

  • operating system;

  • referring and exit pages;

  • pages viewed, links clicked, and approximate time spent on the Services;

  • dates and times of visits;

  • event planners, venues, coordinators, employers, gift purchasers, or other people arranging an order or event on your behalf; and

  • referral partners or publicly available sources, where permitted by law.

If you provide personal information about another person, such as a gift recipient, venue contact, planner, or onsite contact, you represent that you are authorized to provide that information for the purposes described in this Privacy Policy.

2. How We Use Personal Information

We may use personal information to:

  • respond to questions, inquiries, quote requests, and customer-service requests;

  • evaluate availability and prepare custom estimates, proposals, invoices, and agreements;

  • accept, process, fulfill, deliver, and manage orders;

  • coordinate pickup, delivery, venue access, setup, breakdown, and event services;

  • personalize products, packaging, gifting, event styling, and Cheesecake Trolley experiences;

  • process payments, refunds, credits, and transaction records;

  • communicate about inquiries, orders, appointments, delivery, payment, event details, and changes;

  • send newsletters, launch announcements, promotions, or other marketing communications where permitted by law;

  • maintain customer and project records;

  • operate, maintain, secure, troubleshoot, and improve the Services;

  • understand website usage and measure the effectiveness of content and marketing;

  • prevent fraud, misuse, security incidents, and unlawful activity;

  • enforce our policies, agreements, and legal rights;

  • comply with legal, tax, accounting, regulatory, insurance, and recordkeeping obligations; and

  • carry out another purpose disclosed when the information is collected or with your consent.

We will not use uploaded inspiration materials for an unrelated public or promotional purpose without permission.

A. Service providers

We use vendors to help provide the Services and operate our business. These may include:

  • website hosting and design providers, including Wix;

  • ecommerce and storefront providers, including Ecwid by Lightspeed;

  • customer relationship management, inquiry, proposal, invoice, and project-management providers, including HoneyBook;

  • payment processors and financial-service providers;

  • email, text-message, and customer-communication providers;

  • cloud storage, file hosting, data backup, and information-security providers;

  • analytics, troubleshooting, and website-performance providers;

  • delivery, courier, transportation, and event-service providers;

  • accounting, bookkeeping, tax, legal, insurance, and professional advisers; and

  • contractors who assist with production, delivery, setup, staffing, or customer service.

These parties may access personal information only as reasonably necessary to perform services for us, subject to their agreements and applicable law.

B. Event and fulfillment participants

When necessary to complete your order or event, we may share relevant information with venues, planners, coordinators, delivery personnel, onsite contacts, recipients, or other parties involved in fulfillment.

  • comply with a law, regulation, subpoena, court order, or governmental request;

  • protect the rights, property, safety, or security of East Side Cheesecakes, our customers, or others;

East Side Cheesecakes does not sell personal information for money. Based on our current practices, we do not knowingly share personal information for cross-context behavioral advertising as those terms are defined by the California Consumer Privacy Act.

We also do not disclose personal information to third parties for their own direct-marketing purposes without your consent.

If our practices change, we will update this Privacy Policy and provide any notices, links, consent choices, or opt-out mechanisms required by applicable law.

5. Cookies and Similar Technologies

Our website and service providers may use cookies and similar technologies for the following purposes:

  • Essential purposes, such as site operation, security, checkout, shopping-cart functions, fraud prevention, and remembering privacy choices;

  • Functional purposes, such as remembering preferences and improving the user experience;

  • Analytics purposes, such as understanding visits, traffic, performance, and how people use the Services; and

  • Advertising purposes, if advertising or social-media technologies are activated on the website.

Where available, you can manage non-essential cookies through the cookie banner or privacy settings on our website. You may also adjust browser settings to block or delete cookies, but some parts of the Services may not function correctly as a result.

Do Not Track and Global Privacy Control

Some browsers offer a "Do Not Track" setting. Because there is not a uniform industry standard for responding to Do Not Track signals, the Services may not respond to them. Where required by applicable law, we will treat a recognized opt-out preference signal, such as Global Privacy Control, as a request to opt out of sale or sharing for the browser or device sending the signal. Because we currently do not sell or knowingly share personal information for cross-context behavioral advertising, such a signal may not change our current practices.

We may use email or text messages to communicate about an inquiry, quote, order, invoice, delivery, event, customer-service request, or other transaction.

If you opt in to promotional emails, you may unsubscribe using the link included in the message or by contacting us. You may still receive non-promotional communications relating to an active inquiry, order, event, payment, or legal notice.

If you consent to receive text messages, message and data rates may apply. You may opt out of non-essential text messages by replying STOP. For assistance, reply HELP or contact us using the information below. Opting out of promotional texts does not prevent us from sending communications that are necessary to complete a transaction where permitted by law.

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

  • fulfill and document orders and events;

  • maintain customer-service and project records;

  • comply with tax, accounting, legal, insurance, and regulatory obligations;

  • maintain security and prevent fraud.

Retention periods vary depending on the type of information, the nature of our relationship with you, legal requirements, and operational needs. When information is no longer reasonably needed, we may delete, de-identify, or securely dispose of it, subject to technical limitations and lawful retention requirements.

We may need to verify your identity before completing a request. Depending on the request, verification may include confirming information associated with your order, inquiry, or communications. We will use verification information only to process the request. You may use an authorized agent where permitted by law; we may request proof of the agent's authority and may need to verify your identity directly.

We will not discriminate against you for exercising a privacy right provided by applicable law.

10. California Privacy Notice

This section supplements the rest of this Privacy Policy for California residents.

Categories of personal information

Depending on how you interact with us, we may collect the following categories of personal information described under California law:

  • Identifiers, including name, email address, telephone number, postal address, IP address, account identifiers, and online identifiers;

  • Customer-record information, including contact, billing, delivery, and payment-related information;

  • Commercial information, including products or services considered, requested, or purchased, transaction records, preferences, and order history;

  • Internet or electronic-network activity, including website interactions, browser information, device information, cookie data, and usage information;

  • Geolocation information, such as approximate location derived from IP address and addresses provided for delivery or events;

  • Audio, electronic, visual, or similar information, including photographs, logos, invitations, mood boards, and other uploaded materials;

  • Professional or employment-related information, when relevant to corporate gifting, brand events, venue coordination, or business communications; and

  • Inferences, such as product, flavor, event, design, or communication preferences inferred from your interactions with us.

We collect these categories from the sources described in Section 1, use them for the purposes described in Section 2, and disclose them to the categories of recipients described in Section 3.

California privacy rights

Depending on whether and how a California privacy law applies, California residents may have rights to request:

  • information about the categories and specific pieces of personal information collected about them;

  • information about sources, purposes, and categories of third parties to which information is disclosed;

  • deletion of personal information, subject to exceptions;

  • correction of inaccurate personal information;

  • a portable copy of certain personal information;

  • an opt-out of sale or sharing of personal information; and

  • limitation of certain uses or disclosures of sensitive personal information.

East Side Cheesecakes does not currently sell personal information or knowingly share it for cross-context behavioral advertising. We also do not currently use or disclose sensitive personal information for purposes that would require a right to limit under the California Consumer Privacy Act.

Some California privacy statutes apply only to businesses that meet specified legal thresholds. Whether or not a particular statutory right applies, you may submit a privacy request using the contact information in Section 9, and we will review and respond as required by applicable law.

California "Shine the Light"

California Civil Code Section 1798.83 may permit California residents to request information regarding disclosure of personal information to third parties for those third parties' direct-marketing purposes. East Side Cheesecakes does not disclose personal information to third parties for their own direct-marketing purposes without consent.

The Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information online from children under 13. If you believe a child under 13 has provided personal information to us, contact us so we can review and, where appropriate, delete it.

Those third parties may collect information directly from you and process it under their own privacy policies. We are not responsible for the privacy, security, or content practices of services we do not control. Review their policies before providing information.

13. Processing Outside California

East Side Cheesecakes is based in Los Angeles, California. Our service providers may process and store information in other states or countries. Privacy laws in those locations may differ from those where you live. Where required, we and our service providers use appropriate measures for such processing.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, Services, or legal obligations. When we make changes, we will post the updated policy and revise the "Last updated" date. If required by law, we will provide additional notice or obtain consent for material changes.
